In 2019 Oakland decriminalized entheogenic fungi and plants, including Psilocybe cubensis mushrooms and their spores. Decriminalization of possession of a substance means that when caught with an entheogen in Oakland you will not get a criminal offense. You will still get a ticket and possibly face more charges. Psilocybin laws can be passed city to city as they control the police budget. State police and federal entities are still able to prosecute for possession. If found guilty of carrying above the “legal” limit which falls into sales and distribution charges, you will still be prosecuted federally. Courts still like to see the income from cases that big in fees.
